What is Commercial Litigation? 

Commercial litigation is an umbrella term that encompasses a wide array of cases within a business context. Some of the most common types of claims include:

And if things get really murky, they can also involve cross-claims, which is what happens when one Defendant files their own claim against another Defendant, making the case even more complex. These types of cases are ruled by the Uniform Commercial Code (UCC)


What is Complex Litigation? 

The term complex litigation refers to the type of cases where things get significantly more complicated than a regular civil case. This could be due to: 

  • Multiple jurisdictions (multi-district litigation or MDL)

  • International transactions

  • Issues between multiple parties due to counterclaims and cross-claims

  • Antitrust cases

  • Securities fraud

  • Class action suits

  • Racketeering Influenced Corrupt Organizations (RICO)

  • Obscure laws

In complex litigation cases, there are multiple parties and multiple attorneys involved. Also, since these types of cases entail so many individuals, lawyers, and often several geographical locations, they can take years to get resolved. 

Adding insult to injury, the parties may be required to arbitrate their cases or go through administrative proceedings before being able to appeal their cases in Court. 

Attorneys in complex litigation cases often need to obtain the services of several subject matter experts to provide their testimony. And when there are many claims involved, it can take much longer to determine the extent of damages.


Differences Between Commercial Litigation and Other Types of Litigation

Commercial litigation cases are civil cases. Therefore, they have plenty of similarities. For example, in both types of cases, there’s a discovery process. This is where attorneys for both sides seek to obtain all documents, videos, photographs, witness and/or expert testimony, and anything else that may establish proof of what they’re claiming. 

They also require a lot of research of statutes and case law to determine the viability of their claims and possible defenses. 

However, what makes commercial litigation different is that since the Plaintiff is suing a business instead of another individual, there are different elements that must be met. For example, serving the lawsuit to a designated agent (known in the legal world as an agent for service of process). 

In addition, if the entity being sued conducts business in multiple jurisdictions, it may be necessary to file suit in federal court instead of state court. 

These types of lawsuits are also typically more costly, since it often requires the assistance of experts and a lengthier discovery process. 


How to Respond to a Commercial Litigation Claim

Prior to commercial cases being filed, Defendants initially receive a demand letter. Depending on the jurisdiction, the time to reply may vary. If you fail to reply, the Plaintiff may then file their lawsuit. 

Once a lawsuit has been filed, you have to be served. After such time, the clock starts ticking to file your answer. You want to do this timely to avoid entry of a default judgment. 

Regardless of whether you’re answering a demand letter, a lawsuit, or filing a counterclaim or cross-claim, you should always seek the guidance of an experienced attorney. Prevagen is a popular brain health supplement sold by Quincy Bioscience, LLC. The product was marketed as designed to improve memory. The problem with making such claims is that the active ingredient in Prevagen is digested too fast for it to reach the brain in the first place. We represented the Plaintiffs and were able to reach a nationwide settlement.

eBay Price Gouging

The Moskowitz Law Firm and our partners filed a lawsuit in federal court against eBay due to price gouging during the COVID-19 pandemic. We represented a nationwide class of consumers who had significantly overpaid for N95 face masks. The litigation is still ongoing.

Florida Power & Light Water Main Break

Florida Power & Light hired a contractor who negligently caused a water main break in Ft. Lauderdale. As a result over 200,000 people didn’t have access to water, and many businesses were forced to disrupt their operations.
