Numerous Force-Placed Insurance Class Action Cases

The Moskowitz Law Firm has served as co-lead counsel in 31 nationwide class actions filed in various courts across the country against the largest banks and insurers on behalf of millions of homeowners for claims of force-placed insurance. The settlements have already provided $5.9 billion in relief to 5.3 million homeowners nationwide.

Led by Adam M. Moskowitz, The Moskowitz Law Firm currently represents several other consumers in pending nationwide FPI cases.


Recently, the Firm successfully secured settlements which were granted final approval by the U.S. District Court of New Jersey for two force-placed class action cases (Case No. 3:l7-cv-06668 and Case No. 3:17-cv-O6677). The two cases mark the Firm’s 29th and 30th national class settlements, which have been granted final approval in states such as New Jersey and by courts across the country.

These latest settlements not only add to the total monetary relief the Firm has won for its plaintiffs, but have further solidified important injunctive changes regarding overcharges for force-placed insurance, basically ending all of these practices nationwide.

Transamerica COI Litigation

Case No. 2:16-cv-01378-CAS-AJW

The Moskowitz Law Firm serves as co-lead counsel for a nationwide class of consumers that suffered monthly rate increases in their policies with Transamerica Life Insurance Company--one of the world's largest providers of life insurance and other products.

The Firm secured a settlement that was recently granted final approval by Federal Judge Christina Snyder, providing important injunctive relief and $195 million for plaintiffs.


The Moskowitz Law Firm was joined by fellow co-lead counsel Bonnett Fairbourn Friedman & Balint PC and Consumer Watchdog in their efforts to achieve this monumental recovery to resolve the 2016 class action.

Adam M. Moskowitz and his team also represent an additional proposed consolidated class of Transamerica consumers that had COI increases in 2017.


Florida Power & Light Water Main Break

Case No. CACE 19-015483 (08)

When a contractor hired by Florida Power & Light (FP&L) negligently caused a Water Main Break in the heart of Fort Lauderdale, more than 200,000 people were deprived of clean, potable water, forcing business to cease operations and causing extensive damages. The Moskowitz Law Firm’s class action lawsuit seeks to force FP&L and its contractors to pay for the damages they caused through their wanton, reckless, and grossly negligent conduct.


In Fort Lauderdale, safe potable water under pressure is essential to virtually every aspect of operating a business of service. Working with Conrad Scherer, Adam Moskowitz and his team have brought suit in the Circuit Court for the 17th Judicial Circuit in and for Broward County, Florida, to compensate these businesses for the damages directly caused by the defendants’ negligent conduct.


The Apple, Inc. FaceTime Break

Case No. 19-cv-23623

In 2014, Apple, Inc., one of the largest companies in the United States, intentionally “broke” FaceTime in order to force iPhone 4 and 4S users to upgrade to iOS7. Apple broke FaceTime to reduce costs at the expense of customers whose iPhones no longer functioned properly after installing the new operating system. The Moskowitz Law Firm’s lawsuit seeks to certify a Florida class of Apple consumers who own an iPhone 4 or 4S that was damaged as a consequence of Apple’s deceptive and tortious conduct.


A federal court in California recently certified a California class of consumers who were injured as a consequence of Apple’s FaceTime break. Adam Moskowitz and his team have brought a similar action to fight for the many Florida consumers who have been similarly harmed by Apple’s actions.

This case is currently pending in the Southern District of Florida.


Multiple Travel Insurance Class Action Cases

Adam M. Moskowitz and his team currently serve as co-lead counsel in a number of proposed nationwide class actions brought on behalf of millions of consumers who were deceived by some of the largest travel and vacation companies in the world, including Carnival Cruise Lines, Norwegian Cruise Lines, Sandals Resorts, and Alaska Airlines. These corporations, through omission, engaged in a pattern of unlawful profiteering, deceit, and self-dealing with regard to travel insurance policies they sold as distribution participants on behalf of various travel insurers.


It is alleged that the companies created a massive hidden profit center by overcharging passengers for these travel insurance policies, knowing they would receive kickbacks from the travel insurers for each policy sold.

All class members seek injunctive relief, damages, attorneys’ fees, and pre- and post-judgment interest.

The cases are being litigated in federal court in the Southern District of Florida and the Southern District of California.


FieldTurf Multi District Litigation

Case No. 3:17-md-02779-MAS-TJB

Numerous class actions brought against Fieldturf were consolidated in the District of New Jersey Court earlier this year. The class actions were brought by many of the best class action firms in the country for the same allegedly defective artificial fields, which serve as the basis for pursuing the recovery of millions of dollars in damages.

Adam M. Moskowitz of The Moskowitz Law Firm is appointed as co-lead counsel.


He is joined by Chris Seeger of Seeger Weiss LLP, while James Cecchi of Carella, Byrne, Cecchi, Olstein, Brody & Agnello, PC serves as liaison counsel for the plaintiffs.

The court already denied the defendants’ motion to dismiss and the parties are now preparing to seek class certification.


1 Global Investor Class Action Cases

Case No. 18-1438-RBR, Case No. 2019-018039-CA-01, Case No. 2019-025868-CA-01

When 1 Global Capital, a troubled merchant cash advance business, filed for a $300 million bankruptcy in July 2018, the SEC immediately initiated civil enforcement proceedings related to its sale of unregistered securities. The Moskowitz Law Firm and Bonnet, Friedman, Fairbourn & Balint PC, were the first firms in the country to bring multiple class action lawsuits on behalf of 1 Global’s investors against a variety of parties who participated in the company’s illegal sale of unregistered securities. The Firm has successfully settled with over 35 defendants, securing millions of dollars in compensation for these investors.


The Moskowitz Law Firm took an innovative approach in this case, working with counsel for the Debtors and the Creditors’ Committee to assure that investors’ interests were put first in the bankruptcy proceedings. As a consequence of these efforts, the Firm achieved multimillion dollar settlements with many of 1 Global’s brokers, as well as its law firm. Litigation continues, as the Firm pursues additional individuals and entities who may be liable to these investors.

These cases are currently pending in the complex business division for the Circuit Court for Miami-Dade County, Florida and the bankruptcy court for the Southern District of Florida.

Force-Placed (Lender-Placed) Insurance Lawsuits

Adam M. Moskowitz and his team filed the first class action lawsuits challenging the illegal practices of force-placed insurance against Wells Fargo Bank, and were successful in certifying the only litigated class of Florida homeowners with hazard insurance damage. See e.g., Williams v. Wells Fargo Bank, et al, 11-cv-21233 (S.D. Fla.) (J. Scola).

Since that time, Adam has coordinated a coalition of almost 59 different plaintiffs’ law firms from all across the country and successfully brought claims against the largest banks and mortgage services as a result of these coordinated efforts. In addition over 30 class action cases that have already settled and been completed, additional force-placed class action cases are currently being litigated by Adam and his team in Florida and New Jersey. His team is asked to review and investigate claims on behalf of new defendants regularly.
